Complex contractual documentation

Construction contracts can be complex. 

They can contain hundreds of pages of contract conditions, technical specifications, bills of quantities, drawings and programmes. 

They can be difficult for persons who are not familiar with them to understand.

This is a major obstacle to effective monitoring and investigation, as corruption can be concealed or obscured within or by the documentation and can be difficult to identify.  For example:

  • a variation to the contract scope of works could be issued which on the face of the contract and written variation order may appear to be valid, but which in fact was issued for corrupt purposes (e.g. the variations was unnecessary or over priced, or the work was not properly carried out)
  • the unit price of an item in the Bill of Quantities (BOQ) may be corruptly altered, resulting in an overpayment, but the alteration may not have been identified due to the length and complexity of the BOQ.
