Controls: Contract programme

  • Implement effective controls over the compliance by the relevant party with the contract programme (i.e. commencement and completion dates for the whole and parts of the works).
  • The procurement controls (covered in Module 5 “Preventing Corruption in Project Procurement”) should ensure that:
    • the relevant appointed contractor, consultant or supplier is capable of achieving the contract programme
    • the contract specifies:
      • the contract programme
      • when extensions of time for completion should be allowed, and how they are to be calculated
      • when the defaulting party is liable for damages for failure to comply with the contract programme, and how they are to be calculated.
  • Appoint a qualified and honest manager who is responsible for overseeing compliance with the programme, and who:
    • monitors progress against the contract programme
    • records any delays to progress, and the reasons for such delays
    • verifies that there is a legitimate reason for any grant of an extension of time, or the levying of damages for delay
    • verifies that any extension of time granted or damages levied are in accordance with the contract
    • is alert for any suspicious indicators of corruption in relation to the application for or grant of an extension of time, or the levying of damages for delay.
  • Requires the approval of at least two managers where any grant of an extension of time, or the levying of damages for delay, has a high cost or risk impact.
