Contractual documentation: Special Conditions of Contract
The Special Conditions of Contract normally specifies:
any amendments or additions to the General Conditions of Contract
any specific figures (in cases where the General Conditions contain only the calculation principles); e.g.
amount of liquidated damages for delay
the percentage figure over which an adjustment to work quantities leads to a price adjustment
the overhead figure which can be added to the contractor’s price where costs are calculated on an actual cost basis.
The Special Conditions often make such material changes to the text of the General Conditions that the intent and outcome of the international standard form General Conditions (e.g. FIDIC, JCT, NEC) are changed.
