What types of bribery does ISO 37001 aim to help prevent?

ISO 37001 requires the total prohibition by the organisation of, and aims to help the organisation prevent:

  • bribery by the organisation, and by the organisation’s personnel or business associates acting on the organisation’s behalf or for its benefit.
  • bribery of the organisation, or of the organisation’s personnel or business associates in relation to the organisation’s activities
  • all types of bribes, large and small, including facilitation payments
  • all bribes in every country in which the organisation operates.

The only circumstance where a bribe payment would be permitted by the organisation’s strict zero tolerance policy would be if a payment has to be made in order to protect someone’s safety.  For example, if an employee is threatened by an armed policeman at a road block, or a gang member who visits a site, and the employee feels that if they did not make a payment, their safety would be at risk.  Note, that in this type of circumstance most legal systems would treat this as extortion, not bribery, and would not prosecute the person forced to pay.
