Bribery by sub-contractor
Example: The sub-contractor was being paid by the contractor for the equipment and personnel it supplied to the contractor on a day-rate basis. The contractor’s site supervisor was responsible for recording the number of items of excavators and personnel on site every day, and the hours they worked each day. The sub-contractor offered a bribe to the supervisor to certify that it had ten excavators on site when it only had seven. The supervisor refused.
Bribery acts:
The sub-contractor is liable for offering a bribe.
The supervisor is not liable, as the supervisor refused to accept the bribe.
Result:
The sub-contractor’s potential fraudulent claim for payment for an additional three excavators was prevented.
